lasting power of attorney

an lpa is a document that gives another person (or people) the legal power to make decisions for you. you can create an lpa to appoint somebody to deal with your property and financial affairs and/or to make health and welfare decisions on your behalf. for more information, read lasting powers of attorney. 

an lpa remains valid if the person to whom it applies loses their mental capacity. a general power of attorney (gpa) is only valid whilst the person to whom it applies is mentally capable.

making an lpa gives you peace of mind that someone you trust will make important decisions for you when necessary. there are different kinds of lpa: 

• you can make an lpa (financial and property affairs). this gives your attorney the power to make decisions about financial and property matters. they will only have decision making powers when you want them to, or if you lose mental capacity. 

• you can make an lpa (health and welfare). this gives your attorney the power to make decisions about your health and care. they will only have decision making power if you lose mental capacity.
